Safety First At Wendland Family Farm

Please read and complete our liability waiver before participating in applicable on-farm activities and experiences.

Important Notice: Liability Waiver & Release of Claims

This waiver applies to participation in applicable activities and experiences at Wendland Family Farm, including but not limited to U-Picks, workshops, children's programs, farm tours, field trips, photography sessions, private groups and events, and other on-farm activities.

A completed waiver may be required before participating in these activities.

Section 1: Acknowledgment of a Working Farm Environment

I understand that Wendland Family Farm is an active agricultural property and not a perfectly manicured public venue.

Conditions on a working farm may include uneven or changing terrain, holes, mud, wet or slippery surfaces, plants, roots, rocks, dust, pollen, insects, bees and other pollinators, wildlife, tools, irrigation equipment, fencing, farm equipment, crops, changing weather conditions, and other natural or agricultural conditions.

I understand that farm activities and conditions may change throughout the growing season and that not every potential hazard can be identified or eliminated.

Section 2: Assumption of Risk

I understand that entering a working farm and participating in farm activities involves inherent and other risks.

These risks may include, but are not limited to:

Uneven ground, holes, mud, rocks, roots, and slippery surfaces
Trips, slips, and falls
Exposure to insects, bees, wasps, ticks, mosquitoes, and other wildlife
Insect bites or stings
Exposure to plants, pollen, soil, dust, and other potential allergens
Heat, cold, rain, wind, sun, storms, and changing weather conditions
Walking, bending, lifting, carrying, cutting, harvesting, planting, and other physical activities
Use of clippers, garden tools, buckets, containers, and other farm or workshop equipment
Contact with crops, plants, irrigation systems, fencing, structures, and agricultural equipment
Conditions associated with active farming and agricultural operations

I understand that these and other risks may result in injury, illness, allergic reaction, property damage, or other harm.

I voluntarily choose to participate with knowledge of the nature of a working farm and assume the risks associated with my participation to the extent permitted by applicable law.

Section 3: Participant Safety Agreement

While visiting or participating in activities at Wendland Family Farm, I agree to:

Follow all posted signs and instructions from Wendland Family Farm.
Remain within designated visitor and activity areas.
Stay out of production areas, restricted areas, buildings, equipment areas, or other spaces not open to visitors.
Use farm-provided or approved tools and equipment appropriately.
Wear clothing and footwear appropriate for the activity and weather conditions.
Supervise children in my care at all times.
Respect crops, plants, pollinator habitat, equipment, structures, property, and other visitors.
Immediately stop using any tool or participating in any activity if I believe conditions are unsafe.
Notify Wendland Family Farm of an unsafe condition or emergency when reasonably possible.

Closed-toe or sturdy footwear is strongly recommended for most on-farm activities.

I understand that I am responsible for determining whether I and any minors in my care are able to safely participate in the activity.

Section 4: Waiver and Release of Liability

In consideration of being permitted to enter designated areas of Wendland Family Farm and participate in farm activities, I hereby release, discharge, and hold harmless Wendland Family Farm LLC, its owners, employees, volunteers, and representatives from claims, liability, or damages arising from injury, illness, death, or property loss occurring in connection with my participation, to the fullest extent permitted by applicable law.

I understand that this agreement is intended to address risks associated with entering and participating in activities on a working agricultural property.

I acknowledge that I have had the opportunity to read this agreement before participating and that I am signing it voluntarily.

Section 5: Parent or Guardian Acknowledgment

If I am completing this waiver in connection with the participation of a minor, I confirm that I am the minor's parent, legal guardian, or an adult authorized to supervise the minor during the applicable activity.

I understand that children must be appropriately supervised while visiting Wendland Family Farm.

I agree to help the minor understand and follow farm rules, posted signs, activity instructions, and directions provided by Wendland Family Farm.

Section 6: Optional Media Release

Wendland Family Farm occasionally photographs or records activities and experiences for use in farm communications, educational materials, our website, social media, and other promotional purposes.

Your decision regarding photography does not affect your ability to participate.
